1.1. Overview. These Terms and Conditions (“Terms”) between you (“you”, “your”, “User”) and SUKA GAMES LTD, company incorporated under the laws of Republic of Cyprus with registration number: 457805, registered address: Efesou, 9, Paralimni, 5280, Famagusta, Cyprus (“Company”, “we”, “us”, “our”) govern your access to and use of Taitiko Arena Telegram mini-app (collectively, the “App”), all related services (collectively, the “Service”). For ease of reference, the term “Taitiko ARENA” refers to the aggregate of the App and the Service. Taitiko ARENA is a Telegram-based bot game that integrates Web3 elements. By using Taitiko ARENA, you access a game service that includes interactive game mechanics, blockchain-integrated features and other functionalities available through Telegram.
1.2. Acceptance of Terms. By accessing or using the Taitiko ARENA, you acknowledge that you have read, understood, and agree to be bound by these terms, including any additional terms and policies referenced herein, and the Telegram Mini Apps Terms of Service (available at) and the Telegram Terms of Service for Bots (available at). If you do not agree to these terms in their entirety, you are not authorized to access or use the services.
You also agree to be bound by our , and any additional policies incorporated herein. If you do not agree, please do not access or use Taitiko ARENA. Continued use of Taitiko ARENA constitutes your express agreement to these all policies mentioned in this section.
Certain aspects of the Taitiko ARENA, including specific features or functionalities, may be governed by supplementary guidelines, rules, or terms of service. We will provide notice of any such additional terms through the Taitiko ARENA or by other appropriate means, and these additional terms are hereby incorporated into these Terms by reference. In the event of any conflict between these Terms and the additional terms, the provisions set forth in the additional terms shall govern the specific feature or functionality at issue.
1.3. Definitions. The following definitions shall apply to interpret these Terms:
"Account" means a registered account created by User on the Taitiko ARENA by using Telegram.
“Content” refers to all information, data, text, graphics, and other materials made available through the Taitiko ARENA.
“Intellectual Property Rights” means all present and future rights related to Content, patents, copyrights, trademarks, trade secrets, and other proprietary rights.
“Virtual item” means any digital asset available for purchase through the internal shop of Taitiko ARENA, including, without limitation, virtual skins, backgrounds, character reactions, and similar customizable content. Virtual Items are provided solely for use within the Taitiko ARENA and do not confer any ownership rights in the underlying intellectual property or any right to generate profit. All purchases of Virtual Items are final and non-refundable, except as otherwise required by applicable law or as expressly provided in these Terms.
“Honor” means a fictional, non-transferable in-game unit used solely within the Taitiko ARENA environment to enable gameplay-related interactions, such as entering paid game modes and participating in challenges or tournaments. Honor has no monetary value outside the game, is not a digital asset, cryptocurrency, security, or financial instrument, and does not represent any claim, right, or interest in any tangible or intangible asset. It may be acquired in exchange for TON or Telegram Stars and used exclusively within the Taitiko ARENA.
“Telegram Stars” means the digital utility tokens issued by Telegram Messenger Inc. for in-app functions such as purchasing services, advertising, boosting messaging limits, or redeeming rewards. They do not represent an investment or confer any ownership rights and are subject to Telegram’s Terms of Service and applicable guidelines.
“TON” means TON Token which is native cryptocurrency of The Telegram Open Network, used to facilitate transactions, pay fees, and enable various functionalities within the TON blockchain ecosystem.
“Cryptocurrency” means a digital asset secured by cryptographic protocols that operates on a decentralized, peer-to-peer blockchain network.
1.4. Eligibility. To use Taitiko ARENA, you must be at least 18 years old and have full legal capacity to enter into binding agreements. If you are under the age of 18 or lack the legal capacity, use the Taitiko ARENA with the explicit permission and supervision of your parent or legal guardian. In such cases, your parent or legal guardian must read and agree to these Terms on your behalf and will be responsible for all activities conducted through Taitiko ARENA.
If you are a parent or legal guardian permitting a minor or someone without full legal capacity to use the Taitiko ARENA, you agree to these Terms on their behalf and assume full responsibility for their compliance with these Terms.
If you are accepting these Terms on behalf of a company or other legal entity, you represent and warrant that you have the legal authority to bind such entity to these Terms. In such cases, the terms “User” “you” and “your” shall refer to both you as an individual and the entity you represent.
2.1. Service Description. Taitiko ARENA is an asynchronous multiplayer player-versus-player (PvP) game accessible through the Telegram platform. By using the Taitiko ARENA, you acknowledge and agree that Taitiko ARENA offers both free and paid gameplay modes and incorporates a range of in-game features and functions, as described below.
a. Gameplay Modes. Taitiko ARENA offers two game modes for users:
Free Mode: Users may participate in the game without incurring any fees.
Paid Mode: Users can engage in paid game activities by exchanging Telegram Stars or TON for the in-game currency known as Honor.
b. Digital Asset Shop. Taitiko ARENA includes a digital asset shop where users can acquire virtual items such as skins, backgrounds, character reactions, and additional allocations of Honor. These virtual items are designed for cosmetic customization and in-game functionality.
c. In-Game Quests and Missions. The Taiko ARENA features mission-based quests, which require users to complete tasks similar to classic game objectives. Examples include following designated social channels, playing a certain number of matches, or achieving specific gameplay scores. Successfully completing these quests may result in in-game rewards and enhances the overall gaming experience.
d. Future Enhancements. We reserve the right to expand or modify the Taitiko ARENA by introducing additional features such as a Battle Pass subscription program. Such enhancements, if implemented, will provide users with access to exclusive rewards and other benefits as further described in separate communications or published on the relevant pages of Taitiko ARENA.
2.2. Personal Account. To access and use the Taitiko ARENA, you must have a valid Telegram account and authorize via the Telegram platform. By initiating access to Taitiko ARENA, you consent to the creation of a user profile associated with your Telegram account, which may include your Telegram user ID, display name, and other information as permitted by Telegram's privacy settings and/or our Privacy Policy. You are solely responsible for maintaining the confidentiality and security of your Telegram account credentials and for all activities that occur under your account.
You represent and warrant that the information linked to your Telegram account is accurate and that you have the legal capacity to enter into and comply with these Terms. The Company reserves the right to suspend or terminate access to the Taitiko ARENA if we reasonably believe that your account is being used in breach of these Terms or applicable laws.
2.3. In game purchases. In-Game Purchases. Taitiko ARENA permits users to purchase Virtual items and Honor for use within the game which Users may acquire exclusively via Telegram Stars or TON.
Honor is a digital unit with a stable value used solely for engaging in paid gameplay modes. It is not a blockchain token, does not convey any ownership interest, and is intended only as an internal medium of exchange.
Users may convert accumulated Honor into TON in accordance with the procedures established by Taitiko ARENA. All conversion transactions shall incur only minimal fees designed solely to cover operational and processing costs. These fees, along with the applicable conversion rate, will be clearly disclosed to the User prior to the confirmation of any conversion transaction.
Users acknowledge and agree that the conversion process involves inherent risks, including but not limited to technical errors, network delays, software malfunctions, system interruptions, and other unforeseen issues that may affect the accuracy, timeliness, or completeness of the conversion. Accordingly, all conversion transactions are final and non-refundable, except as otherwise required by applicable law.
By initiating a conversion transaction, you assume all risks associated with the conversion process and agree that Taitiko ARENA and its affiliates shall not be liable for any direct, indirect, incidental, consequential, or special losses arising from, or in connection with, any failure or error in the conversion process. You further acknowledge that it is your responsibility to carefully review all transaction details before confirming the conversion. Taitiko ARENA reserves the right to modify conversion fees, rates, or procedures at its sole discretion, with notice provided through the Taitiko ARENA in accordance with these Terms.
2.4. Refund policy. Except as provided for in cases where an error in the purchase process or a processing failure occurs, all transactions for in-game purchases are final and non-refundable. Furthermore, while Users may purchase Virtual items for personal use within the game, such assets may not be traded, resold, or otherwise transferred to other Users. The Taitiko ARENA does not incorporate any advertising.
If our investigation determines that a technical failure on the part of Taitiko ARENA prevented the successful delivery of a purchased Virtual item, we will, at our discretion: (i) take all necessary measures to deliver the Virtual item successfully, or (ii) where it is feasible and appropriate, provide a refund or credit equal to the value of the undelivered Virtual item.
In the event Taitiko ARENA is permanently discontinued for reasons other than Company`s bankruptcy, insolvency, or analogous insolvency proceedings, Users shall be entitled to refunds for the proportionate value of unused Honor and unused Virtual items based on their original purchase price, payable in TON or the original payment method at Company’s discretion. Refunds are contingent upon Users submitting verifiable proof of purchase within 30 days of discontinuation. The Company reserves the right to modify or terminate this refund obligation in cases of force majeure, regulatory action, or technical constraints beyond its control.
2.5. Third-Party Integrations. Taitiko ARENA may integrate with and rely on certain third-party services to support its functionality and performance. These include, without limitation:
Document storage services, such as Google Drive, for the secure management of certain operational or user-related data;
Hosting and infrastructure services, such as Amazon Web Services (AWS), for the deployment and operation of the application and related systems; and
Analytics services, such as Google Analytics, to collect and analyze usage data in order to improve the user experience and monitor performance metrics.
By using the Taitiko ARENA, you acknowledge and agree that your data may be processed by these third-party service providers in accordance with their respective terms of service and privacy policies. We do not control and are not responsible for the content, privacy practices, or operations of such third parties. However, we take reasonable measures to ensure that any data shared with these providers is limited to what is necessary for the performance of the Taitiko ARENA and is handled in accordance with applicable data protection laws and our Privacy Policy.
Your use of the Taitiko ARENA constitutes your consent to such third-party integrations, and you understand that the Company disclaims any liability arising from the acts or omissions of these third-party providers.
2.6. Acceptable Use Policy. By using the Taitiko ARENA, you agree to adhere to the following acceptable use guidelines. You agree to use Taitiko ARENA in compliance with these Terms and all applicable laws and regulations. The following actions are strictly prohibited and constitute a material breach of these Terms:
- Lawful Use: You shall use the Taitiko ARENA exclusively for lawful purposes and in full compliance with these Terms, as well as all applicable local, state, national, and international laws and regulations.
- Preservation of System Integrity: You agree not to engage in any activity that may harm, disable, overburden, or otherwise impair the Taitiko ARENA’s infrastructure or its operation. This includes, but is not limited to, initiating any form of denial-of-service attack, distributing malware, or otherwise interfering with the performance of the Taitiko ARENA.
- Unauthorized Access Prohibition: You shall not attempt to gain unauthorized access to the Taitiko ARENA, its systems, networks, or any data or resources that you are not expressly permitted to access. Any such attempts may result in immediate legal actions.
- Compliance with Guidelines: You agree to comply with all usage guidelines, restrictions, and instructions provided by the Company from time to time, whether these are communicated via these Terms or through other official channels.
- No Endorsement and Preservation of Proprietary Notices: You agree not to imply that any of your statements or actions are endorsed by the Company unless expressly authorized, nor may you remove, alter, or obscure any copyright, trademark, or other proprietary notices appearing on the Taitiko ARENA or related materials.
- Investment Fraud: You are prohibited from promoting fraudulent schemes (e.g., "pump-and-dump" crypto scams, fake airdrops) using Taitiko ARENA.
- Money Laundering: You are prohibited from using Taitiko ARENA’s to obfuscate illicit fund flows or evade sanctions (e.g., OFAC-prohibited jurisdictions).
- Phishing or other types of scam: You are prohibited from creating fake websites, emails, or social media accounts mimicking Taitiko ARENA to deceive users into connecting digital wallets, sharing private keys, recovery phrases, payment details or other personal information.
- Scraping Prohibition: You are strictly prohibited from using bots, crawlers, scripts, or other automated tools to extract, collect, or replicate data from Taitiko ARENA without prior written consent. This includes bypassing technical safeguards or overloading our infrastructure.
- Cheating or Exploiting Bugs: You are prohibited from using, creating, or distributing exploits, cheats, unauthorized automation, or manipulating the Taitiko ARENA in any way that provides an unfair advantage or disrupts gameplay.
- Account Sharing or Selling: You are prohibited from transferring, renting, sharing, or selling Accounts or Account credentials to any third party.
- Toxic Behavior and Harassment: You are prohibited from engaging in abusive, threatening, harassing, discriminatory, or otherwise harmful behavior towards other users, moderators, or representatives of the Taitiko ARENA.
- Impersonation: You are prohibited from falsely representing yourself as another person, entity, developer, or representative of the Taitiko ARENA.
- Use of Unauthorized Third-Party Software: You are prohibited from using bots, scripts, mods, or any unauthorized third-party software or tools to interact with or manipulate the game or its systems.
- Farming or Botting: You are prohibited from engaging in automated gameplay (botting), repetitive tasks for financial gain (farming), or other activity intended to manipulate the in-game economy.
- Exploiting Economic Systems: You are prohibited from manipulating the in-game currency or reward mechanisms in a manner that violates the intended gameplay balance or economic fairness.
- Posting Inappropriate Content: You are prohibited from sharing or publishing any content that is illegal, obscene, sexually explicit, defamatory, hateful, or otherwise objectionable within the Taitiko ARENA or associated platforms.
- Circumventing Suspensions or Bans: You are prohibited from attempting to bypass, evade, or otherwise circumvent any suspension, ban, or other enforcement actions applied to your account or access.
Failure to comply with these acceptable use provisions may result in:
Temporary ban, namely restriction of the User's access to Taitiko ARENA or temporary suspension of Account;
Immediate suspension or termination of your access to Taitiko ARENA;
Technical measures (e.g., IP blocking, bot detection) to prevent further violations;
Disclosure of your identity and activities to law enforcement, regulatory agencies, or harmed third parties.
Civil claims for losses caused to the Company or third parties;
Criminal prosecution under applicable laws;
Regulatory penalties for breaches of data protection, financial, or sanctions laws.
The Company reserves the right to recover all reasonable costs incurred in enforcing these Terms, including investigation fees, legal expenses, and damages.
3.1. Company`s ownership. The Taitiko ARENA, including any models, interfaces, algorithms, indexes or other software developed by the Suka Games LTD (company incorporated under the laws of Republic of Cyprus with company number: 457805), along with all associated features, functionality, and tools, is protected by copyright, trademark, patent, trade secret, and other intellectual property laws of the Republic of Cyprus and international jurisdictions. You acknowledge and agree that the App and all related intellectual property rights are the exclusive property of the Suka Games LTD and its licensors. You are prohibited from removing, altering, or obscuring any copyright, trademark, service mark, patent marking, or other proprietary rights notices incorporated in or accompanying the Taitiko ARENA.
3.2. Trademarks. The company name, the term "Taitiko ARENA" the company logo, and all related names, logos, product and service names, designs, and slogans are trademarks of the Suka Games LTD or the Company or its affiliates or licensors. You must not use such marks without the prior written permission of the Suka Games LTD and or the Company. All other names, logos, product and service names, designs, and slogans on the Taitiko ARENA are the trademarks of their respective owners.
3.3. Acceptable use of Intellectual Property. The Company and Suka Games LTD grants you a limited, non-exclusive, revocable, non-transferable license to use Taitiko ARENA`s gameplay-related intellectual property (e.g., in-game characters, gameplay footage, game mechanics, and audiovisual content) solely for the purpose of creating non-commercial, fan-based content (“User Content”). This license explicitly excludes logos, trademarks, trade names, and branding elements unless expressly authorized in writing.
Under this license, you may:
Create and share gameplay videos, walkthroughs, tutorials, or reviews (e.g., on YouTube);
Produce fan art, animations, or other creative works derived from Taitiko ARENA’s gameplay content;
Discuss Taitiko ARENA`s in informational or editorial content.
This provision does not grant rights to use the Company`s or Suka Games LTD`s logos, trademarks, or branding. Any use of the Company`s or Suka Games LTD`s trademarks or logos requires separate written permission.
You retain ownership of your User Content. The Company does not claim ownership of User Content created under this license.
User Content must not be monetized, sold, or used for commercial purposes (e.g., advertisements, merchandise, paid promotions) without Company`s prior written consent.
The Company and/or Suka Games LTD reserves the right to revoke this license at any time, for any reason, and may require removal of User Content that violates these terms.
The Company and Suka Games LTD disclaims liability for User Content and you agree to indemnify The Company and Suka Games LTD against claims arising from your User Content.
4.1. Service Provided “AS IS.”. The Taitiko ARENA and its services are provided on an "as is" and "as available" basis, without any express or implied warranties of any kind. The Company expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to any warranties of merchantability, fitness for a particular purpose, non-infringement, title, or that the Taitiko ARENA’s Content or services will be accurate, error-free, uninterrupted, secure, or free of harmful components. Users are solely responsible for verifying any information obtained through the Taitiko ARENA before relying on it for any purpose.
4.2. No Guarantee of Uninterrupted Service. We do not warrant that the Taitiko ARENA will be continuous, error-free, secure, or free of viruses, malware, or other harmful components.
4.3. Limitation of Liability. To the maximum extent permitted by law, in no event shall the Company, its affiliates, officers, directors, employees, contractors, licensors, or agents be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to lost profits, lost revenues, lost data, business interruption, reputational harm, or any other losses arising out of or in connection with:
The use of, inability to use, or reliance on the Taitiko ARENA or its Content;
Any inaccuracies, errors, or omissions in the Taitiko ARENA`s Content;
Any third-party actions, services displayed on the Taitiko ARENA; or
Any modifications, discontinuation, suspension, or termination of the Taitiko ARENA or its services.
This limitation applies regardless of the legal theory of liability, whether based on contract, tort, negligence, strict liability, or any other cause of action, and whether or not the Company was advised of the possibility of such damages.
If, notwithstanding the foregoing, the Company is found liable for any claims arising from or related to the use of the Taitiko ARENA, Company`s aggregate liability shall in no event exceed the amount of $500 (five hundred US dollars).
Some jurisdictions may not permit the exclusion or limitation of certain damages; in those cases, the limitations shall apply to the maximum extent permitted.
4.4. Risk Acknowledgment. By using Taitiko ARENA, you acknowledge and accept the following risks:
Platform Dependency: Taitiko ARENA operates as a mini-app within the Telegram platform. Functionality, availability, or performance may be disrupted by Telegram’s platform changes, outages, or policies.
Blockchain Risks: Transactions involving TON conversions or withdrawals carry inherent risks, including network delays, irreversible errors, market volatility, or losses due to third-party actions.
Non-Refundable Purchases: In-game purchases are final and non-refundable except as explicitly stated in these Terms, and their value or utility may be altered or discontinued.
Technical Vulnerabilities: Bugs, exploits, or security flaws in Taitiko ARENA or Telegram’s ecosystem may compromise gameplay fairness, account security, or digital assets.
Financial Stakes: Paid Mode outcomes are final and non-reversible, with no guarantees of returns, and users bear all risks of financial loss.
Regulatory Uncertainty: Legal or regulatory changes in your jurisdiction may restrict access to blockchain features, virtual currencies, or gameplay mechanics.
You agree to indemnify, defend and hold harmless the Company, our subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third-party using Taitiko ARENA
6.1. Modification to Terms. The Company reserves the exclusive right to amend these Terms at any time. The amended Terms will be published on the Taitiko ARENA by appropriate means with a revised "Last Updated" date in the header. Continued use of the Taitiko ARENA after the effective date of the revised Terms constitutes your acceptance of the changes. We recommend that you review these Terms periodically.
6.2. Access termination. The Company reserves the right to immediately suspend or terminate your access to the Taitiko ARENA without prior notice if we have reasonable grounds to suspect that you have:
Violated the Acceptable Use Policy;
Engaged in any illegal activities using the Taitiko ARENA; or
Violated these Terms in any other way.
6.3. Modifications to App and Suspension rights. The Company reserves the right to modify, suspend, or terminate access to Taitiko ARENA at any time for maintenance, updates, security, legal compliance, or operational reasons, without prior notice. Users acknowledge that the Company is not liable for interruptions, loss of progress, virtual items, or damages arising from such actions. No compensation or refunds will be provided for disruptions unless legally required. Continued use of Taitiko ARENA constitutes acceptance of all modifications. This provision survives termination of user accounts or access to the game.
7.1. Governing Law. These Terms shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without reference to any conflict of law principles. This means that regardless of where you reside or use our services, the laws of the Republic of Cyprus will exclusively apply.
7.2. Initial Negotiations. In the event of any dispute or claim arising out of or relating to these Terms or your use of the Taitiko ARENA, both parties (i.e., you and the Company) agree to first attempt to resolve the matter through good faith negotiations. We encourage open communication and a mutual effort to settle any issues before proceeding further.
7.3. Mediation. If a resolution cannot be reached through negotiation, both parties agree to submit the dispute to mediation. The mediator shall be chosen by mutual agreement. If you and the Company are unable to agree on a mediator within a reasonable timeframe, the Company will appoint a mediator on behalf of both parties. Mediation is intended to be a non-binding process aimed at facilitating an amicable resolution.
7.4. Binding Arbitration. Should mediation fail to resolve the dispute, the parties agree to resolve the matter through binding arbitration. The arbitrator will be selected by mutual agreement. If no mutual agreement can be reached regarding the selection of an arbitrator, the Company shall have the authority to appoint one.
7.5. Litigation as a Last Resort. In the unlikely event that both mediation and arbitration fail to resolve the dispute, either party may pursue litigation. Any such litigation shall be brought exclusively in the competent courts of the Republic of Cyprus.
7.6. Language of Proceedings. All negotiations, mediation sessions, arbitration hearings, and any subsequent litigation proceedings shall be conducted exclusively in the English language.
7.7. Time Limit for Claims. Any claim or cause of action arising from or relating to these Terms or the use of the Taitiko ARENA must be initiated within one (1) year from the date the cause of action arises. If a claim is not brought within this timeframe, it will be deemed waived and barred.
Any notices or communications permitted or required under these Terms must be provided in writing by the Company. Such communications may be delivered by:
For any notice sent via email, the date on which the email is transmitted shall be deemed the date of receipt.
9.1. Severability. If any provision of these Terms is found by an arbitrator or court of competent jurisdiction to be invalid, void, or unenforceable, in whole or in part, such provision shall be enforced to the maximum extent permitted under applicable law, and the remaining provisions shall continue in full force and effect.
9.2. Entire Agreement. These Terms, together with our Privacy Policy and any other documents expressly incorporated herein, constitute the entire agreement between you and the Company regarding the use of the Taitiko ARENA.
9.3. Assignment. The Company may assign or transfer these Terms, in whole or in part, without notice. You may not assign or transfer any rights or obligations under these Terms without our prior written consent.
9.4. Waiver. The failure of the Company to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
9.5. Headings. Section headings are for convenience only and shall not affect the interpretation of these Terms.
10.2. Feedback. Any feedback you provide regarding the Taitiko ARENA may be used by the Company for improving the Taitiko ARENA without any obligation to you.
